One Myth about the Pardon for Václav Havel

In the third quarter of December 1989, the then Prime Minister of Czechoslovakia, who was also acting as President of the Republic at the time due to the vacancy of that office, granted a pardon to Václav Havel, a candidate for the office of President of the Republic. The reason for granting this pardon has been repeatedly justified by both the direct participant, i.e. the then Prime Minister, and historians, on the grounds that, according to the law at the time, only a person with a clean criminal record could be elected President of the Republic. This article shows that although this explanation is still widely accepted and appears in many historical publications devoted to the turn of 1989, it is not based on truth. The Czechoslovak legal system at the time did not stipulate a condition of good character; on the contrary, it explicitly stated that any citizen could be elected, “regardless of their previous activities”. The question of what the reasons or considerations of both participants were, i.e. the then and future prime minister on the one hand and the future president of the republic on the other, remains open, probably for historians.
Czech original: Ve třetí čtvrtině prosince 1989 udělil tehdejší předseda československé vlády, vykonávající současně pravomoci prezidenta republiky v době uprázdnění tohoto úřadu, milost Václavu Havlovi, kandidátu na úřad prezidenta republiky. Potřebnost udělení této milosti je jak přímým účastníkem, tedy tehdejším předsedou vlády, tak i historiky, opakovaně zdůvodňována tím, že podle tehdejšího práva mohl být prezidentem
republiky zvolen pouze trestně bezúhonný člověk. Tento článek ukazuje, že ačkoliv se toto vysvětlení stále traduje a objevuje v mnoha historických publikacích věnovaných přelomu roku 1989, nezakládá se na pravdě. Československý právní řád v tehdejší době podmínku bezúhonnosti nestanovoval, naopak výslovně uváděl, že zvolen může být každý občan, mj. „bez ohledu na svou předchozí činnost“. Otevřenou otázkou, patrně pro historiky, zůstává, jaký byl důvod či úvahy obou účastníků, tedy tehdejšího a budoucího předsedy vlády na straně jedné a budoucího prezidenta republiky na straně druhé.
