(In)temperate Judicial Speech in Judicial Process

This article focuses on speeches made or written in the context of judicial decision-making. With every speech, a judge should pursue his or her interest in the good functioning of the judiciary by keeping in mind other interests that contribute to the good functioning of the judiciary. These sub-interests and objectives are independence, impartiality, dignity, respect for other judges and members of other legal pro¬fessions and public confidence. In this article, I discuss several situations in which these interests have not been adequately protected. I point out the ethical shortcomings of each manifestation and analyse them through a series of questions. Answering them could help judges keep their speeches within ethical bounds so that they do not compromise any of the sub-interests that contribute to the good functioning of the judiciary. In the end, I argue that judges will express themselves in a manner consistent with these interests and will not compromise them when they exercise restraint.
Czech original: Tento článek se věnuje projevům, které zazněly nebo byly napsány v souvislosti s rozhodovací činnosti soudců. Soudce by měl každým svým projevem sledovat zájem na tom, aby justice dobře fungovala,
a to díky tomu, že bude mít na zřeteli i další zájmy, které k dobrému fungování soudnictví přispívají. Těmito dílčími zájmy a cíli jsou nezávislost, nestrannost, důstojnost, respekt k ostatním soudcům a zástupcům jiných právních profesí a důvěra veřejnosti. V článku se věnuji několika situacím, v nichž tyto zájmy nebyly dostatečně
chráněny. Poukazuji na etické nedostatky jednotlivých projevů a rozebírám je pomocí řady otázek. Jejich zodpovězení by soudcům mohlo pomoci udržet jejich projevy v etických mezích tak, aby neohrozily
žádný z dílčích zájmů, který přispívá k dobrému fungování justice. Nakonec tvrdím, že se soudci budou projevovat v souladu s těmito zájmy a neohrozí je tehdy, když budou zdrženliví a budou se projevovat zdrženlivě.
