Current Issues of the Definition of the Legal Instrument of Dependent Work
Czech original: Aktuální otázky vymezení závislé práce
The article offers reflection on selected problems associated with the definition of dependent work. It successively deals with three areas. In the first part, the author discusses atypical forms of work perfor¬mance, for which a certain degree of subordination and dependence is typical, but it can be problematic to fulfill all the signs of dependent work. In this context, attention is mainly paid to professional athletes and workers via digital platforms. In the second part, the recent change in the definition of illegal work aimed at facilitating the work of control authorities is analyzed. The last part is devoted to legislative changes to remote work. In the end, the author offers the opinion that even in atypical and problematic cases, the special protective function of labor law cannot be disregarded.
Czech original: Článek nabízí zamyšlení nad vybranými problémy spojenými s vymezením závislé práce. Postupně se zabývá třemi oblastmi. V první části rozebírá atypické formy výkonu práce, pro něž je typická jistá míra
podřízenosti a závislosti, může však být problematické splnění všech znaků závislé práce. Pozornost je přitom věnována především profesionálním sportovcům a pracovníkům přes digitální platformy. V druhé části je analyzována nedávná změna definice nelegální práce směřující k ulehčení činnosti kontrolních orgánů. Poslední část se věnuje legislativním změnám práce na dálku. V závěru autor nabízí úvahu, že i v atypických a problematických případech nelze odhlížet od zvláštní ochranné funkce pracovního práva.
