Rises and Falls of the European Investment Policy in Its Fifteen

In 2024, it will have been 15 years since the Lisbon Treaty entered into force. This milestone also marks 15 years of the European Union’s common investment policy, as foreign direct investment became an exclusive competence of the EU under the expanded common commercial policy introduced by the Lisbon Treaty. Fifteen years is a period long enough to assess how much the EU was successful or perhaps unsuc¬cessful in this field. Surely, the period 2009–2024 was marked by several turnarounds, including the last-minute deals, policy reversals and court disputes over competencies. The goal of this contribution is to map those developments and critically evaluate them. Accordingly, the main attention, within limited space given by the scope of the article, focuses on the major pillars of the EU investment policy: international trade and investment negotiations with third countries, Energy Charter Treaty modernization, multilateral negotiations at the United Nations Commission on International Trade Law (UNCITRAL) and the EU framework for foreign direct investment screening.
Czech original: V roce 2024 uplynulo patnáct let od vstupu Lisabonské smlouvy v platnost. To také znamená, že investiční politika Evropské unie existuje již stejně dlouhou dobu poté, co se oblast přímých zahraničních investic stala součástí rozšířené společné obchodní politiky EU v její výlučné pravomoci. Patnáct let je také dostatečně dlouhá doba k bilancování toho, co se EU na tomto poli povedlo a nepovedlo. Je nepochybné, že období mezi roky 2009 a 2024 bylo poznamenáno několika zvraty, včetně kompetenčních soudních sporů, politických obratů a dohod učiněných na poslední chvíli. Tento příspěvek se je pokusí na omezeném prostoru přiblížit a nabídnout jejich kritické zhodnocení. Proto se soustředí na hlavní oblasti unijní investiční politiky, kam spadají mezinárodní vyjednávání o obchodních a investičních dohodách se třetími zeměmi, modernizace Dohody k Energetické chartě, mnohostranná vyjednávání na půdě Komise OSN pro mezinárodní obchodní právo (UNCITRAL) a unijní rámec pro prověřování přímých zahraničních investic směřujících do EU.
