Romanian Precedent: Constitutional Aspects of Annulling Election Results in the Slovak Republic and the Sovereignty of Election

The decision of the Romanian Constitutional Court to annul the first round of the presidential elections has caused a strong uproar not only among politicians but also within the professional legal community. The aim of the article is to analyze this decisions in the context of the conditions of Slovak constitutional law. In the first part, the article focuses on the key aspects of the decision of the Romanian Constitutional Court. In the second part, it analyzes the case law of the Slovak Constitutional Court and argues whether a similar decision could be rendered in Slovakia. In the last part, it points to the relevant case law of the European Court of Human Rights (ECHR) and defines the new concept of the “sovereignty of elections”, which has its roots in the material core of the Constitution.
Czech original: Rozhodnutie rumunského ústavného súdu anulovať prvé kolo prezidentských volieb vyvolalo širokú polemiku nielen medzi politikmi, ale aj medzi odbornou verejnosťou. Cieľom príspevku je analyzovať toto rozhodnutie v kontexte podmienok slovenského ústavného práva. V prvej časti sa článok zameriava na kľúčové aspekty rozhodnutí rumunského ústavného súdu. V druhej časti analyzuje judikatúru slovenského Ústavného súdu a polemizuje či by bolo možné vydať obdobné rozhodnutie na Slovensku. V poslednej časti poukazuje na relevantnú judikatúru Európskeho súdu pre ľudské práva a definuje novú podmienku „suverenitu volieb“, ktorá má korene v materiálnom jadre ústavy.
