Restrictions on Freedom of Expression in the Context of Securitization of Law

The article deals with the current state and development trends of freedom of expression in the Czech Republic. It is based on an observable trend of gradual restriction of this fundamental freedom and identifies the main cause as the growing fear of disinformation, hate speech and other security threats. The article interprets this development through two key concepts – the securitisation of law and the culture of fear. Securitization of law refers to the tendency to transform societal problems into security issues, opening space for the expansion of state regulation at the expense of individual rights. The culture of fear then creates an environment in which public debate is dominated by fear, which legitimises restrictive measures. The article builds on The Future of Free Speech’s international research (2015–2022), which confirms the global trend of restricting free speech in democratic countries. The analysis focuses on specific legislative acts concerning the Czech Republic. The research part is based on case studies that show how threats are constructed and used as a basis for restricting free speech. The article draws attention to the absence of counterbalancing liberalisation measures and warns of the long-term consequences of unilateral regulation.
Czech original: Článek se zabývá aktuálním stavem a vývojovými trendy svobody projevu v České republice. Vychází z pozorovatelného trendu postupného omezování této základní svobody, přičemž za hlavní příčinu identifikuje narůstající obavy společnosti z dezinformací, nenávistných projevů a jiných bezpečnostních hrozeb. Článek interpretuje tento vývoj prostřednictvím dvou klíčových konceptů – sekuritizace práva a kultury
strachu. Sekuritizace práva označuje tendenci transformovat společenské problémy v otázky bezpečnosti, čímž se otevírá prostor pro rozšiřování státní regulace na úkor individuálních práv. Kultura strachu pak vytváří prostředí, v němž je veřejná debata ovládána obavami, což legitimizuje restriktivní opatření. Článek navazuje na mezinárodní výzkum organizace The Future of Free Speech (2015–2022), který potvrzuje globální trend omezování svobody projevu v demokratických zemích. Analýza tohoto článku se zaměřuje na konkrétní legislativní akty týkající se České republiky. Výzkumná část je založena na případových studiích, které ukazují, jak jsou hrozby prezentovány a využívány jako základ pro omezování svobody projevu. Článek upozorňuje na absenci vyvažujících liberalizačních opatření a varuje před dlouhodobými důsledky jednostranné regulace.
