Today’s and Tomorrow’s Children – protecting their Rights in the Context of Climate Change
Czech original: Dnešní i budoucí děti – ochrana jejich práv v souvislosti s klimatickou změnou
Since the adoption of the Paris Agreement to the UN Framework Convention on Climate Change in 2015, there has been a growing number of cases around the world where states‘ climate commitments are the subject of litigation based on human rights violations. There is also a growing number of cases involving children as plaintiffs or complainants whose rights have been infringed. Children have a particularly impor¬tant procedural position in climate litigation, given the rights protected by the UN Convention on the Rights of the Child, and can also be agents for environmental protection for future generations of children who have not yet been born. In the Czech Republic, children have not yet been involved in any of the climate cases before the courts. In view of the adoption of the UN Committee on the Rights of the Child’s General Comment No. 26, which interprets the Convention on the Rights of the Child with regard to the negative impacts of environmental pollution and climate change on children’s rights, and the Czech Republic’s binding contribution to the reduction of greenhouse gas emissions, which was submitted by the European Union to the Secretariat of the UN Framework Convention on Climate Change, this paper summarises from the perspective of Czech law the background and problematic aspects of children’s involvement in human rights climate litigation.
Czech original: Po přijetí Pařížské dohody k Rámcové úmluvě OSN o klimatické změně v roce 2015 přibývá po celém světě případů, kdy jsou klimatické závazky států předmětem soudních sporů založených na porušení lidských práv. Přibývá také případů, v nichž v pozici žalobců či stěžovatelů, do jejichž práv bylo zasaženo, figurují děti. Děti mají vzhledem k právům chráněným Úmluvou OSN o právech dítěte v klimatické litigaci mimořádně významné procesní postavení a mohou být zároveň prostředníky pro ochranu životního prostředí pro budoucí generace dětí, které se ještě nenarodily. V České republice se děti do žádného z klimatických případů řešených před soudy zatím nezapojily. S ohledem na přijetí Komentáře č. 26 Výboru OSN pro práva dítěte, který interpretuje Úmluvu o právech dítěte s ohledem na negativní dopady znečištění životního prostředí a klimatické změny na práva dětí, a na závazně stanovený příspěvek České republiky ke snížení emisí skleníkových plynů, který byl Evropskou unií odevzdán sekretariátu Rámcové úmluvy OSN o změně klimatu, tento příspěvek shrnuje z pohledu českého práva východiska i problematické aspekty zapojení dětí do lidskoprávní klimatické litigace.
