Independent Oversight of Intelligence Services in the Czech Republic

The oversight of intelligence services is an important prerequisite for their proper functioning, especially for maintaining legality and efficiency in their activities and preventing the possibility of abuse of their position. The article defines independent oversight as one type of intelligence oversight, and possible approaches to its implementation. It highlights the problematic points associated with its functioning, especially with regard to the realities associated with the creation of the so-called Independent Control Body. This was a positive step towards adding an independent element to the Czech intelligence oversight system and towards fulfilling the expectation of creating a truly independent and credible expert body. An assessment of the aspects of independent oversight of the intelligence services clearly leads to the conclusion that it is effective and beneficial for their effective, balanced and politically neutral oversight. The greatest value added in terms of the fulfilment of the principles of the democratic rule of law is the definition of legality in the activities of intelligence services as an essential subject of interest for their independent oversight.
Czech original: Kontrola zpravodajských služeb je významným předpokladem pro jejich řádné fungování, především pro zachování zákonnosti, efektivity v jejich činnosti a předcházení možnosti zneužití jejich postavení.
Článek vymezuje nezávislou kontrolu jako jeden z druhů kontroly zpravodajských služeb a možné přístupy k jejímu naplnění. Poukazuje na problematické body spojené s jejím fungováním, zejména s ohledem na reálný stav spojený s vytvořením tzv. Orgánu nezávislé kontroly. Jeho vytvoření je pozitivním krokem doplňujícím kontrolní systém zpravodajských služeb ČR o nezávislý prvek a směřujícím k naplnění očekávání vytvoření opravdu nezávislého a důvěryhodného expertního orgánu. Hodnocení aspektů nezávislé kontroly zpravodajských služeb vede jednoznačně k závěru o její účelnosti a přínosu pro účinný, vyvážený a politicky neutrální dohled nad nimi. Největším hodnotovým přínosem z pohledu naplňování principů demokratického právního státu je stanovení zákonnosti činnosti zpravodajských služeb jako podstatného předmětu zájmu jejich nezávislé kontroly
