Abandonment of the Immovable Property with a Focus on Unknown Owners
Czech original: Opustenie nehnuteľnosti so zameraním sa na nedostatočne identifikovaných vlastníkov
Pursuant to Section 1050(2) of the Czech Civil Code, if the owner does not exercise the right of ownership over the real estate for ten years, he is deemed to have abandoned the real estate. In the case of insufficiently identified owners, this provision is followed by Section 65 of the Czech Cadastral Act, which regulates the process for investigating cases of insufficiently identified owners, whereby Section 65(9) provides that if the owner cannot be identified, the property shall be deemed abandoned if the time limit provided for by the Civil Code expires. In the present paper, the author discusses the implications of Section 1050(2) of the Civil Code in conjunction with Section 65 of the Cadastral Act, considers their consistency with the protection of the right to property as a fundamental human right, and also refers to the Slovak example of dealing with the issue of insufficiently identified owners in the past.
Czech original: Podľa § 1050 ods. 2 českého občianskeho zákonníka platí, že ak vlastník nevykonáva vlastnícke právo k nehnuteľnosti po dobu desiatich rokov, má sa za to, že nehnuteľnosť opustil. V prípade nedostatočne identifikovaných vlastníkov na toto ustanovenie nadväzuje § 65 českého katastrálneho zákona, ktorý upravuje proces šetrenia prípadov nedostatočne identifikovaných vlastníkov, pričom v § 65 ods. 9 ustanovuje, že ak sa vlastníka nepodarí zistiť, hľadí sa na vec ako na opustenú, ak uplynie lehota ustanovená občianskym zákonníkom. V predkladanom príspevku sa autor venuje dopadom § 1050 ods. 2 občianskeho zákonníka v spojitosti § 65 katastrálneho zákona, zamýšľa sa nad ich súladnosťou s ochranou vlastníckeho práva ako základného ľudského práva, pričom poukáže aj na slovenský príklad riešenia otázky nedostatočne identifikovaných vlastníkov v minulosti.
