Age of Rights? Human Duties in the Light of Kant’s Philosophy

The age of rights has been replaced by the age of proportionality. Human dignity is the highest absolute value from which other fundamental rights are derived. The absolute theory of human dignity is based on Kant’s concept of dignity of rational beings. But what if Kant’s concept of dignity is more about duties than rights? How does Kantian deontology combine with the proportionality of relativizing fundamental rights? The article analyses Kant’s conception of duty in the Doctrine of Right in the context of the concept of dignity in the Groundwork for the Metaphysics of Morals and in the Doctrine of Virtues, and it follows the development of a different philosophical interpretation in the contemporary discussion on human rights.
Czech original: Věk práv vystřídal věk proporcionality. Lidská důstojnost je nejvyšší absolutní hodnota, z níž se odvozují ostatní základní práva. Absolutní teorie lidské důstojnosti vychází z Kantova konceptu důstojnosti rozumných bytostí. Co když ale Kantův koncept důstojnosti je více spojen s povinnostmi, než s právy? Jak se kantovská deontologie snoubí s proporcionalitou relativizující základní práva? Článek analyzuje Kantovo pojetí povinnosti v Právní nauce v kontextu pojmu důstojnosti v Základech metafyziky mravů a v Nauce o ctnostech a sleduje vývoj odlišné filozofické intepretace v současné lidskoprávní diskusi.
