Legislature of the Czech Republic in the Year 2011: analytical and Comparative Survey

The artical creates a part of the regular quantitative monitoring and description of the Czech legislature which is persued last five years and its results are published on the pages of the journal of Právník. The aim of this article is more profound and detailed analysis of definite indicators of the quality and development of the Czech legislature especially from the point of view of comparison selected periods of social development and the whole time succession from the year 1918 up to now. In this case the comparison could be done first time for the period of last five years. The legislature of the CR is described by special set of variables (indicators) that enable quantitative expresion of definite atributes like structure of legislative forms (law acts, regulations etc.) and its relations, division of the legislative documents according to legal branches (like constitutional, civil or penal law for excample) etc. Special attention is devoted to the phenomenon of change in legislature understand as the element of evolution or development. In details are analysed changes identified in the CR legislature especially in the last five years. The conclusions reflect primarily growth of legislative activity in the year 2011. The proportion between private and public law was mildly changed in the direction of fostering the branch of private law. The most significant from the point of view of the development of the CR legislature is enormous amount of novelisations of legislative acts that reflects the extraordinaly effort for change of legislature as a whole from the political coalition governed now in the Czech Republic.
Czech original: Článek přináší pravidelný doplněk k základnímu přehledu stavu a vývoje české legislativy za rok 2011 v jeho kvantitativním vyjádření. Jeho smyslem je hlubší a podrobnější analýza vybraných ukazatelů kvality a vývoje legislativy ČR, a to mj. z hlediska porovnání časových řad i celých období.V tomto případě je již poprvé možné na základě jednotné metodiky přistoupit k porovnávání posledních pěti let. Zvláštní pozornost je i v tomto článku, stejně jako v případě obdobných studií, které jej předcházejí, věnována celkovým posunům na základě porovnání s obdobím od roku 1918 do současnosti a posledních let. Popisován je stav platné legislativy i její přírůstky za příslušné roční období v rozdělení podle základních legislativních typů, resp. forem a rovněž v porovnání agregovaných proměnných primárních a sekundárních předpisů. Zároveň je zachycena a porovnávána proporční struktura těchto legislativních forem. Komparativnímu pohledu je podrobena rovněž struktura legislativy z hlediska základních právních odvětví, která odráží jeden z podstatných pohledů na obsahovou stránku legislativy a právního řádu vůbec. Nakonec je prezentována analýza dynamiky legislativy prostřednictvím novelizační aktivity. Podrobně jsou konfrontovány změny a jejich podíly v jednotlivých letech od roku 2007, kdy byly tyto analýzy poprvé publikovány na stránkách časopisu Právník. Následuje srovnání s referenčními roky reprezentujícími uplynulá desetiletí. Závěry reflektují zejména skutečnost opět zvýšené legislativní aktivity v roce 2011 po jejím přechodném snížení, zvýšení proporčního podílu odvětví soukromého práva na úkor práva veřejného, a zejména též mimořádně vysokou míru novelizační aktivity, která prozrazuje enormní intenzitu reformního úsilí příslušné vládnoucí koalice.
