Restorative justice is on the rise, and not only in the Czech Republic. Despite this, a significant portion of the public and legal professionals remain sceptical of this concept. One possible reason for this, which is rarely considered, is the excessive emphasis on the differences between restorative justice and contemporary society. It is generally accepted that the restorative idea originated from the adoption of the traditions of the indigenous peoples of the former colonies of the British Empire. However, this way of pre¬senting it is largely counterproductive, as it highlights cultural and demographic differences. Taking into account the historical origins of restorative thinking, such a summary is also incomplete. The aim of this article is to highlight the much broader historical background of restorative justice than is traditionally presented. On this basis, it will then present the universality of restorative thinking across communities and the associated implications for its presentation.
Czech original: Restorativní justice je na vzestupu, a to nejen v České republice. A přesto nemalá část veřejnosti i právních profesionálů je k tomuto konceptu skeptická. Jedním z možných důvodů, ke kterému se zřídkakdy
přihlíží, je přílišné zdůrazňování odlišností mezi restorativní justicí a současnou společností. Obecně je přijímáno, že restorativní myšlenka vznikla přejímáním tradic původních obyvatel bývalých kolonií Britského
impéria. Tento způsob prezentace je ovšem do větší míry kontraproduktivní, neboť poukazuje na kulturní a demografické rozdíly. S přihlédnutím k historickým počátkům restorativního myšlení je takovéto shrnutí rovněž neúplné. Cílem článku je tak poukázat na mnohem širší historické pozadí restorativní justice, než je tradičně uváděno. Na tomto pak předestřít univerzálnost restorativní myšlenky napříč společenstvími a s tím spojené důsledky pro její prezentaci.
