The trial of US v. Tomoyuki Yamashita and his Significance for the Concept of Superior Responsibility

The aim of the presented article is to introduce and analyze the legal and factual aspects of the American postwar trial against Japanese general Tomoyuki Yamashita, which took place in the Philippines shortly after the end of World War II, with a special focus on the so called command responsibility, i.e. the responsibility of superior for the crimes committed by his subordinates. In addition to the legal and factual aspects of the proceedings, the article tries to take into account other social and political influences that could have shaped the final form of the judgment. Besides the analysis of the trial itself, the presented text also tries to put the proceedings in the context of other postwar trials, in which the issue of the command responsibility was also examined, and also outline the development of the institute of command responsi¬bility in the postwar years. The question of the command responsibility is still relevant, as current events prove, and the justification of the decision in Yamashita’s case presents one of the fundamental, if partially overcome, approaches to this complex issue. The conclusions in the Yamashita case thus still contribute to the discussions about some issues of international criminal law and as such are worth examining.
Czech original: Cílem předkládaného článku je představit a analyzovat právní i skutkové aspekty amerického poválečného procesu proti japonskému generálovi Tomojuki Jamašitovi, který se odehrál na Filipínách těsně po skončení druhé světové války, se zvláštním zaměřením na otázku zkoumanou v procesu jež se týkala odpovědnosti nadřízeného za zločiny spáchané jemu podřízenými osobami. Článek se kromě skutkových a právních otázek, které byly v rámci procesu řešeny, snaží zohledňovat i další společenské a politické vlivy,
které mohly formovat výslednou podobu rozsudku. Kromě samotné analýzy procesu se text rovněž snaží dát toto řízení do kontextu jiných poválečných procesů, ve kterých byla otázka odpovědnosti velitele rovněž zkoumána, a v závěru rovněž v hrubých rysech nastínit vývoj institutu odpovědnosti velitele v poválečných
letech. Otázka odpovědnosti velitele za případné zločiny podřízených je stále aktuální, jak ostatně dokazují
současné události, a odůvodnění rozhodnutí v Jamašitově případu prezentuje jeden ze základních, i když dnes již částečně překonaných přístupů k této poměrně složité a závažné problematice. Závěry ve věci Jamašita tak mohou i dnes přispět k diskuzím vedeným ohledně některých otázek mezinárodního práva trestního a jako takové stojí za zkoumání.
