The most Extensive Changes to the ICSID Arbitration Rules in their History: Evolution or Revolution?

The article analyses the fundamental changes brought about by the most extensive amendment of the procedural rules of the International Centre for Settlement of Investment Disputes (ICSID) in the last 55 years. The amendment process has been underway since 2016 and the new rules entered into force on 1 July 2022. The ICSID Rules govern the majority of investment disputes. The authors focus for the first time on the changes to the Arbitration Rules under the ICSID Convention. This is followed by an introduction to the changes in the ICSID Supplementary Rules. The article then introduces the new stand-alone ICSID Mediation Rules and the ICSID Fact-Finding Rules. In addition to presenting the amendment itself, the authors also reflect on its content in the context of the ongoing debate on the reform of international investment arbitration. The authors also consider to what extent this extensive amendment is a natural evolution of existing practice or whether it also contains truly revolutionary elements.
Czech original: Článek analyzuje zásadní změny, které přinesla nejrozsáhlejší novelizace procesních pravidel Mezinárodního střediska pro řešení investičních sporů (ICSID) za posledních 55 let. Proces novelizace probíhal od roku 2016 a nová pravidla vstoupila v platnost 1. července 2022. Pravidly ICSID se řídí většina investičních sporů. Autoři se nejprve zaměřují na změny v Rozhodčích pravidlech podle Úmluvy ICSID. Na to navazuje představení změn v Doplňkových pravidlech ICSID. Článek poté představuje nová samostatná Mediační pravidla ICSID a Pravidla ICSID pro zjišťování skutečností. Kromě přiblížení samotné novely autoři také reflektují její obsah v kontextu probíhající diskuse k reformě mezinárodní investiční arbitráže. Autoři se také zamýšlejí, do jaké míry je tato rozsáhlá novelizace přirozenou evolucí dosavadní praxe, nebo zda obsahuje i opravdu revoluční prvky.
