Metaphysical Elements in Contemporary Czech Constitutional Discourse
Czech original: Metafyzické prvky v současném českém ústavním diskursu
Metaphysical arguments have started appearing in the contemporary Czech constitutional discourse, in the literature as well as in the case-law of the Constitutional Court. They touch upon topics such as the nature and justification of human rights, the sovereignty of the people, including its content and manifestation, or the so-called material core of the constitution. This article first delimits the notion of metaphysics and presents the criticism of its appearance in legal and political argumentation. The next part describes the role of metaphysics in the thinking about the state and the constitution, including its relation to legal fiction. The third part of the article exposes the relationship between metaphysics and democracy, since the key concept of democracy, namely the people, can in fact be perceived as an abstract and metaphysical category. The conclusion points out the inevitability of using metaphysical vocabulary, which however should not lead to a replacement of persuasive and generally acceptable argumentation by references to seemingly obvious truths arising from the nature of things.
Czech original: V současném českém ústavním diskursu, literatuře i judikatuře Ústavního soudu se objevujímetafyzické argumenty. Týkají se např. povahy a zdůvodnění lidských práv, suverenity lidu, jejího obsahu a projevů, či tzv. materiálního ohniska ústavy. V článku je nejdříve vymezen pojem metafyziky a předestřena kritika jejího užívání v právní a politické argumentaci.V další části je nastíněno místo metafyziky v přemýšlení o státu a ústavě, včetně jejího vztahu k fikcím. Třetí část článku exponuje poměr metafyziky a demokracie, neboť klíčový pojem demokracie, totiž lid, může být vnímán právě jako abstraktní a metafyzickákategorie.V závěru je poukázáno na nevyhnutelnost užívání metafyzického slovníku, jenž by všakneměl svádět k nahrazování přesvědčivě a obecně přijatelné argumentace odkazy na zdánlivě očividné pravdy plynoucí z podstaty věcí.
