Where is the Law?

Legal theory increasingly accepts the idea that a legal norm is not contained in formal sources of law but in human mind. Legal norm is thus not the object or starting point of interpretation of law or of legal texts but its result. This article argues that locating legal norms in human mind is not compatible with the traditional definitions of law as a normative system with particular features; a general acceptance of this idea would require fundamental changes in legal theory. It presents arguments against this new concept, by way of suggesting that: 1. the functioning of law is based on traditional legal concepts, 2. Women and men believe in the binding force of many legal norms, which they didn’t know, because this norms are contained in the formal sources of law. Legal norm is an idea and information and as such it can exist simultaneously in many places, but in order for it to become a legal norm it has to exist in some formal source of law.
Czech original: V právnom myslení a to prevažne v kvalitnej odbornej spisbe sa presadzuje názor, že právna norma nie je obsiahnutá v prameni práva vo formálnom zmysle, ale v ľudskej mysli a nepredstavuje predmet výkladu práva, či skôr právneho textu, ale až jeho výsledok. Stať argumentuje, že uvedené koncepcie sú nezlučiteľné s tradičným chápaním práva ako normatívneho systému určitých vlastnostní a ich prípadné všeobecné prijatie by si vyžiadalo zásadnú zmenu právnej teórie. Proti ich správnosti uvádza, že právna prax pôsobí na základe tradičného chápania práva, že ľudia sú presvedčení o záväznosti mnohých právnych noriem, ktoré nepoznajú, lebo sú obsiahnuté v prameni práva vo formálnom zmysle. Právna norma je myšlienkou a informáciou, a preto sa môže zároveň nachádzať na viacerých miestach. Právnou normou je však vtedy, keď sa nachádza v niektorom prameni práva vo formálnom zmysle.
