Enforceability and the Enforcement of Decisions of the Constitutional Court of the Czech Republic

The enforceability of the Constitutional Court decissions is legally differentiated according to different types. The actual enforcement is not the same; it is complicated in the annulments of the decisions of general courts. The issue of whether the enforceable decision of the Constitutional Court (Art. 89 para. 2 of the Constitution) was binding erga omnes in other comparable cases and not only in the present matter was quite controversial. It was also questionable whether the findings were binding only in the verdict, or also in its reasoning. The case law of Constitutional Court has undergone evolution; earlier decision allow for exceptions to the so-called precedents and the binding force of such findings and stress the binding power of cassation, while some older verdicts do not mention the possibility of exceptions to the binding force of precedents. The article includes reference both to German literature as well as domestic literature.
Czech original: Vykonatelnost nálezů Ústavního soudu je podle zákona rozlišena podle jednotlivých druhů. Reálná vynutitelnost není stejná; nejsložitější je u nálezů zrušujících rozhodnutí obecných soudů. Sporná byla zejména otázka, zda jsou vykonatelná rozhodnutí Ústavního soudu (čl. 89 odst. 2 Ústavy) závazná erga omnes i v jiných srovnatelných případech, či jen v dané souzené věci. Dále bylo sporné, zda nález rušící soudní rozsudek je závazný jen ve výroku, či i v jeho odůvodnění. Judikatura Ústavního soudu prošla určitým vývojem; mladší rozhodnutí připouštějí výjimky z tzv. precedenční závaznosti nálezů a bazírují na závaznosti kasační, zatímco některé starší judikáty možnost výjimky z precedenční závaznosti nálezů nezmiňují.
