Effectiveness of Social Organisation, Legal Systems and their Collapse
Czech original: Efektívnosť spoločenských organizácií, právnych systémov a ich kolaps
The article deals with the evaluation of effectiveness of legal and other social systems. The used method can be described as a “mathematical and statistical approach” and does not belong to traditional “economics of law” in which the effectiveness depends on contents of law. The author supposes that in the case of the numerical growth of components in any system (including legal norms in legal system) costs of the system grow more quickly than gains from the system. In a certain moment therefore the profit from the existence of the system starts to decline because each new added component costs more than a value it can produce. If such a development continues the system reaches a situation when costs of the system are higher than gains from its existence. The system can collapse. The society can prevent such a development only by increasing of quality of individual components and by decreasing of operating costs. The legal system is not excluded from impacts of these principles. It means that an increased legislative activity and a production of new and new legal norms – without a significant qualitative revolution – will decrease functionality and effectiveness of the legal system which could even collapse.
Czech original: Článok sa venuje otázke posudzovania účinnosti právnych a iných spoločenských systémov z pohľadu matematicko-štatistických zákonitostí. (Nie z pohľadu zaužívanej „ekonomickej analýzy práva“, pre ktorú táto závisí od obsahu práva.) Autor sa domnieva, že v prípade rastu počtu prvkov v systéme (vrátane právnych noriem v právnom systéme) náklady na systém rastú rýchlejšie než príjem zo systému. V jednom momente preto celkový zisk zo systéme začne klesať, lebo nové pridané prvky už spôsobujú pokles celkového zisku. Ak takýto vývoj pokračuje, dosiahne sa stav, keď náklady prevýšia príjmy a systém môže skolabovať. Takémuto vývoju je možné zabrániť len zvyšovaním kvality jednotlivých prvkov a znižovaním nákladov na ich činnosť. Právny systém nie je vylúčený z pôsobenia týchto zákonitostí. Znamená to, že zvýšená legislatívna činnosť a produkcia nových a nových právnych noriem – v prípade ak nedôjde ku kvalitatívnej revolúcii – začne znižovať funkčnosť a efektívnosť právneho systému, ktorý môže dokonca skolabovať.
