The Law in Boarder Situations – the Plank of Karneades or above the Humbleness of the Law-making

Nowadays we tend to solve any problem we have through passing of new regulation. Is it possible to regulate everything with the law? Is it possible in order to protect own life to take the life of another person who did not cause a threat to our life? Not even philosophy (deontology or utilitarianism) can give a satisfactory answer. On examples of historical (the plank of Carneades) and contemporary border situations (shooting down an aircraft), the author shows that there are situations where the state (and law) is helpless and a man is in order to preserve life in natural state of war of all against all. Two shipwrecked men are struggling to hold onto one wooden plank in the middle of the ocean. The plank can support only one of the two men. Should one of the shipwrecked push the other off the plank? Or, would it be better if both hold on and drown? It is possible that the state authorities sacrifice innocent human life to save another person’s life? Is it possible to regulate this situation by law? It seems that we increasingly underestimate meta-law factors of regulation. There are situations when the public power does not have much opportunity to intervene and consequently cannot condemn an act of self-help resulting from the powerless state and necessity, but has only to take note. The law and the state as well have their limits.
Czech original: V dnešnej dobe máme tendenciu riešiť akýkoľvek problém prijatím novej právnej regulácie. Je to veľmi pohodlné pre politikov i pre ich voličov. Máme radi jasné odpovede na otázku, čo je dobré a čo zlé. Dá sa však všetko regulovať právom? Možno v záujme ochrany vlastného života siahnuť na život iného človeka, ktorý hrozbu nášmu životu nespôsobil? Uspokojivú odpoveď nevie dať ani filozofia (deontologický či utilitaristický prístup). Na príkladoch historických (Karneadova doska) i súčasných hraničných situácií (zostrelenie lietadla) autor dokazuje, že sú situácie, keď je štát (a aj právo) bezmocný a človek je v záujme zachovania života v prirodzenom stave vojny všetkých proti všetkým. Dvaja stroskotanci sa snažia udržať na drevenej doske plávajúcej uprostred oceánu. Doska môže udržať iba jedného z nich. Môže jeden sotiť toho druhého z dosky? Alebo je lepšie, aby sa držali obaja a obaja utopili? Je možné, aby štátne orgány obetovali nevinný ľudský život na záchranu iného ľudského života? Je možné takúto situáciu regulovať právom? Zdá sa, že čoraz viac podceňujeme meta-právne faktory regulácie. Sú situácie, keď verejná moc nemá možnosť zasiahnuť a akt z toho plynúcej svojpomoci nemôže odsúdiť, ale len vziať na vedomie. Právo a štát má svoje limity.
