On the Changes in the Perception of the Concept of Legal Power

The article deals with the actual meaning of the term “legal power”, both in the Czech academic literature and in jurisprudence. The article points to the fact that the Czech law has a large number of different enforceable titles. Each of these enforceable titles has its own mode of judicial enforcement. Legal power and judicial enforcement are closely related. The author believes, that the theory should not only focus on legal power of the judicial decisions but also on exploration of the nature of the other enforcement orders. The newly constituted general theory of the effects of legal power should not assume that the legal power is a purely procedural institute. The author bases its argumentation on specific court verdicts which are dealing with the nature of different types of enforcement orders. Finally the author compares the conclusions of the judicature with theories that deal with the institute of legal power and enforceability.
Czech original: Článek se zabývá aktuálním obsahem pojmu „právní moc“, a to jak v české literatuře, tak v judikatuře. Upozorňuje na skutečnost, že český právní řád zná řadu různých exekučních titulů. Každý z těchto exekučních titulů má svůj vlastní režim vykonatelnosti. Právní moc a vykonatelnost spolu přitom úzce souvisejí. Autor se domnívá, že teorie by se měla zaměřit nejen na zkoumání podstaty právní moci soudních rozhodnutí, ale i na zkoumání právní moci a vykonatelnosti ostatních exekučních titulů. Nově konstituovaná všeobecná teorie účinků právní moci exekučních titulů by podle názoru autora neměla vycházet z předpokladu, že právní moc je čistě procesním institutem. Zmíněný závěr autor dokládá konkrétními judikáty, které zaujímají stanovisko k podstatě právní moci u různých exekučních titulů. Tyto judikáty autor konfrontuje se současnými i historickými teoriemi, které se věnovaly institutu právní moci a vykonatelnosti.
