Comprehensibility of Law

This article deals with the concept of comprehensibility of and in law. It starts by tackling general issues of legal language, its nature and functions. By naming some of the characteristics of the legal language, it proceeds by discussing the concept of comprehensibility as an issue of legal language. Drawing on experience and analyses from English-speaking environments, this article further places the concept of comprehensibility not only in its linguistic but also its legal contexts. Based on this theoretical discussion, this article further proceeds by asking what is the Czech Constitutional Court’s understanding of the concept of comprehensibility. The following analysis shows that comprehensibility is not only a matter of – or a characteristic of – a legal text, but rather a principle. This principle – or a part of the contents of the principle of a democratic and legal state – is understood as one of the basic principles of law and of composition of legal texts.
Czech original: Tento článek se zabývá pojmem srozumitelnosti v právu.Odrazovým můstkem pro tento text bude zakotvení srozumitelnosti v české právní úpravě. V návaznosti na tuto právní úpravu je srozumitelnost diskutována v širším teoretickém kontextu jako požadavek kladený na právní komunikaci a jsou analyzovány její místo, role a obsah v systému práva jako kulturně-diskursním celku. Základem pro diskusi o srozumitelnosti práva je srozumitelnost v kontextu použité formy komunikace práva, tedy právního jazyka. První, teoretická část tohoto článku se tedy zabývá právním jazykem, jeho charakteristikami a funkcemi. Na tuto teoretickou část navazuje praktická analýza pojmu srozumitelnosti a jejího chápání především v judikatuře Ústavního soudu ČR. Tato analýza ukazuje, že tak, jak srozumitelnosti rozumí český právní systém prostřednictvím judikatury vrcholných soudů, se nejedná pouze o pojem, ale o koncept, který je jak praktickým požadavkem kladeným na právní komunikaci, tak nabývá charakteru principu.
