The Right to Send an Employee on a Business Trip within the Czech Republic?
Czech original: Právo vyslat cizince na pracovní cestu v rámci České republiky?
There are no specific legal regulations restricting employers’ right to send an employee on a business trip. However, application practice as represented by both the Labour Inspections and the Labour Office of the Czech Republic is different. Although the legal basis for strict interpretation as used by these bodies is rather weak, employers are instructed to prohibit the relocation of employees if they are Third-Nationals. This paper deals with this practice and its legal consequences.
Czech original: Článek pojednává o problematické praxi kontrolních orgánů, které nutí zaměstnavatele na základědiskutabilní právní úpravy nevysílat cizince, občany z třetích států, na pracovní cesty v rámci Českérepubliky. Článek analyzuje relevantní pracovněprávní předpisy i recentní judikaturu. Na závěr je vedleprávní argumentace zařazeno stručné zamyšlení o ekonomických a demografických souvislostech.
