Annotation:
This publication addresses the issue of informed consent from both legal and ethical perspectives. While many authors regard informed consent merely as a legal formality, the book offers a broader view, emphasizing that the concept is fundamentally rooted in ethical values.
In addition to presenting the requirements of Czech law, the book provides a comparative overview of foreign legal frameworks. It also introduces readers to related ethical and legal concepts, such as advance directives, informed refusal (so-called negative consent), surrogate consent, and others.

The monograph explores theoretical issues, particularly legal terminology, questions of causality, the principle of double effect, culpability, and intention. It further provides an analysis of relevant legal regulations in various European countries, with a detailed focus on the current situation in the Czech Republic.
Special attention is given to the impact of the case law of the European Court of Human Rights, which plays a crucial role in shaping the Czech legal context.

Doležal, Adam a Doležal, Tomáš. Kauzalita v civilním právu se zaměřením na medicínskoprávní spory. Praha: Ústav státu a práva AV ČR, v.v.i., 2016. 261 stran. Edice Kabinetu zdravotnického práva a bioetiky. ISBN 978-80-87439-28-9.
Annotation: This book explores the concept of causality within legal discourse. The authors address a complex and, in the Czech legal environment, still underappreciated issue: the causal link between cause and effect. The monograph covers not only theoretical reflections on the notion of causality, but also examines causal relationships in the contexts of science, philosophy, and linguistics. It further analyzes existing legal regulations and presents a number of model examples and relevant case law. Special attention is given to the issue of causal nexus in medico-legal disputes.
The authors provide in-depth discussion of problematic types of causality - such as concurrent, cumulative, alternative, and hypothetical causation and offer practical guidelines for establishing causality in these cases. This book will be of interest to a wide range of professionals, as causality is not merely an abstract concept but plays a crucial and practical role in law: it links a person’s action to their legal responsibility.

From the review by Mgr. Ondřej Lehký: "The publication Stem Cells – Ethical and Legal Aspects of Research, published by the Institute of State and Law of the Czech Academy of Sciences, is a collaborative work by David Černý and Adam and Tomáš Doležal. The authors aim to introduce readers to one of the most debated and controversial bioethical issues of our time. “Internationally, there are few scientific topics that receive such extensive attention in public discourse, the mass media, and political debate as the issue of stem cells. This topic is highly relevant and deeply controversial in the fields of the life sciences, medical sciences, bioethics, and medical law. A thorough examination of the subject requires addressing all of its dimensions: philosophical values that inevitably influence practical ethical decision-making in research; political factors that shape the legal norms; and commercial or economic aspects. This publication summarizes and analyzes the various approaches, with particular emphasis on the underlying assumptions grounded in philosophical ethics and the philosophical concept of personhood. Such foundations, if they could lead to a clear and true answer, ought to serve as guidance for other disciplines. The persistent issue in philosophy, however, is the recurring inability to reach consensus on whether such a definitive answer can even be found.
The publication is aware of this limitation and therefore works from a set of defined assumptions—though not claiming them to be absolute truths.”
