Legal Expert Systems and Representation of Rules as Code

In the times of digitization and COVID crisis, it seems advisable to investigate the possibilities, which automatization offers for law. This article specifically describes legal expert systems, which are com¬puter databases of knowledge which can find answers to legal questions with the ambition to provide a comparable level of quality to legal experts in a given field, using rule-based artificial intelligence. The article starts with a context summary to make clear that these systems will not replace judges by robots and that the model of legal thinking and reasoning is really only a model, which by far does not match the quality of the human brain, let alone the argumentation in legal discourse. The article then summarizes the history of legal expert systems, which spans over more than 50 years of research with mixed results, but also the ar¬guments of the critics. It clarifies the presumptions for successful use of legal expert systems and describes the necessary composition of any legal expert system and its specific implementation. It follows, from the historic overview, that the current level of technology is probably in the phase when after the exaggerated expectations, it will now grow in a more general manner and based on the more recent concept of represen¬tation (Rules as Code). Rules as Code can be one of the possible solutions to a speed up the proces and offer smart help in the crisis and also an aid for correct, transparent and flexible settings of rules in the state administration, especially in the IT systems. We already know of successful examples in developed countries such as France, Great Britain, the USA or New Zealand where these technologies help. The article concludes with an example of a simple legal expert system, which facilitates the application of the freedom of informa¬tion legislation.

Czech original: V době digitalizace a koronavirové krize je na místě zkoumat možnosti, které nabízí automatizace v oblasti práva. Konkrétně tento článek popisuje právní expertní systémy, což jsou počítačové databáze znalostí, které umí najít odpovědi na právní otázky s ambicí poskytovat v dané oblasti srovnatelně kvalitní odpovědi jako právní expert, a to pomocí pravidlové umělé inteligence. Článek nejprve shrnuje kontext, aby bylo jasné, že nejde o nahrazování soudců roboty a že model právního uvažování či usuzování je skutečně jen model, který zdaleka nedostihuje kvalitu lidského mozku, natož argumentace v právním diskurzu. Článek shrnuje historii právních expertních systémů, která má za sebou již přes 50 let výzkumu se smíšenými výsledky, ale také argumenty kritiků. Článek upřesňuje předpoklady úspěšného využití právních expertních systémů a popisuje nezbytné složky každého právního expertního systému a jejich konkrétní implementaci. Z historického přehledu vyplývá, že se tato technologie patrně nachází ve fázi, kdy po původním přehnaném očekávání pomalu nabírá druhou mízu, a to v rámci obecnějšího a novějšího konceptu reprezentace pravidel pomocí kódu (Rules as Code). Reprezentace pravidel v kódu může být jedním z možných řešení pro rychlou a chytrou pomoc v krizi i pro správné, transparentní a flexibilní nastavení pravidel ve státní správě, zejména v souvislosti s informačními systémy. Již existují úspěšné příklady z vyspělých ekonomik Francie, Velké Británie, USA či Nového Zélandu, kde tyto technologie pomáhají. Článek je završen příkladem jednoduchého právního expertního systému usnadňujícího aplikaci zákona o svobodném přístupu k informacím.
