The International Legal Regime of Antarctica Two Hundred Years Since its Discovery

This year marks the two hundredth anniversary of the discovery of Antarctica. This paper describes the development of the legal regime from the perspective of international law. However, the paper cannot refer to all legal issues pertaining to the continent around the South Pole. The aim of this text is to summarise the development which preceded the conclusion of the Antarctic Treaty of 1959, particularly the claims of the seven countries to parts of Antarctica. The paper summarises the development of the relationto Antarctica and analyses the international legal regime of Antarctica as acontributing factor in view ofother comparable international legal regimes. The paper also points to some negative features of this regime.The part of the Czech Republic in maintaining the international legal regime of Antarctica and its incorporation into domestic law are an important part of the text.
Czech original: V tomto roce uplyne dvě stě let od objevení Antarktidy. Tento článek mapuje vývoj právního režimu Antarktidy z hlediska mezinárodního práva. Příspěvek však nemůže reagovat na všechny právní otázky týkající se tohoto kontinentu okolo jižního pólu. Cílem příspěvku bylo zaměřit se jednak na shrnutí vývoje, který předchází uzavření Smlouvy o Antarktidě z roku 1959, zejména pokud jde o nároky sedmi států na části Antarktidy. Článek shrnuje vývoj ve vztahu k Antarktidě. Dále analyzuje antarktický právní režim z hlediska jeho přínosnosti i pro jiné, srovnatelné mezinárodněprávní režimy. V příspěvku je poukázáno i na některá negativa tohoto režimu. V neposlední řadě je text zaměřen i na vnitrostátní realizaci antarktického smluvního režimu a úlohu České republiky v tomto režimu.
