Alexy’s Weight Formula

The proportionality principle is one of the most important contemporary methodological guidelines for decision-making of constitutional courts. In 2003 Robert Alexy introduced his concept of the Weight Formula as a tool for assessment of the most problematic of the three criteria of the proportionality test. The balancing rule of that last criterion has been described by Robert Alexy as follows: “The greater the degree of non-satisfaction of, or detriment to, one right or principle, the greater must be the importance of satisfying the other.” Alexy’s Weight Formula constitutes the subject matter of this paper. The author attempts to elucidate the Formula as clearly as possible and subsequently apply it to a number of selected decisions of the Czech Constitutional Court. The aim of the paper is to experimentally validate the hypothesis that the Weight Formula is a practical as well as convincing instrument of balancing colliding constitutional principles. It should also answer the question to what extent the Formula can help identify the differences in relevant opinions in the event of rational disagreement. The paper concludes the Formula does constitute an applicable instrument of constitutional argumentation. It can be employed in the process of judicial oversight over individual breaches of basic rights as well as exercising constitutional review powers. The Formula’s applicability extends even into the sphere of disputes within organic constitutional law. The Weight Formula serves in the very least as a tool to make argumentation of constitutional courts clearer and easier to understand for the public. Among other aspects, the paper reacts to some of the criticisms which have been mounted against the Formula.
Czech original: Princip proporcionality je dnes jedním z nejvýznamnějších metodických vodítek pro rozhodování ústavních soudů. V roce 2003 přišel Robert Alexy se svou vážící formulí coby nástrojem k posouzení nejproblematičtějšího ze tří kritérií testu proporcionality, onoho třetího, jehož pravidlo poměřování formuluje Robert Alexy takto: „Čím větší je míra nenaplnění či omezení jednoho principu, tím větší musí být důležitost naplnění principu jiného.“ Alexyho vážící formuli se věnuje tento článek. Snaží se ji co nejsrozumitelněji vysvětlit a poté aplikovat na několik vybraných rozhodnutí českého Ústavního soudu. Cílem je experimentálně ověřit, zda se jedná o praktický a přesvědčivý nástroj poměřování kolidujících principů a zda jeho prostředí může případně přispět k identifikaci rozdílnosti v názorech v situaci rozumné neshody. Článek dospívá k závěru, že se o použitelný nástroj ústavněprávní argumentace jedná a že jej lze použít jak pro přezkum individuálních zásahů do základních práv, tak pro abstraktní kontrolu ústavnosti nebo dokonce i na střety právních principů organického ústavního práva. Vážící formule může přispět přinejmenším ke zpřehlednění a lepšímu pochopení argumentace ústavních soudů. Článek také reaguje na některé kritiky, které jsou vůči vážící formuli vznášeny.
