Constitutional Engineering According to the Czech Custom or the Changes in the Competence of the President of the Republic

The introduction of direct election of the president of the Czech Republic was an incentive to possible changes of the president’s role in the Czech constitutional system. After the first direct election in 2013, we could observe attempts to weaken the moderation aspect of the office of the president in favour of political leadership. In response to this development, the government initiated an amendment to the Constitution, which mostly concerned the powers of the president. In the commentary to the bill, the proposed constitutional changes were sorted according to their importance and closely examined (moderate strengthening of the position of the president, clarifying his powers, weakening or cancelling his powers). It is however pointed out that any changes to the constitutional text have meaning only when there exist either a will to voluntarily follow the constitutional rules, or a pressure of the institutional surroundings, which makes the changes compulsory to follow.
Czech original: Zavedení přímé volby prezidenta republiky představuje stimul možné změny prezidentské role v českém ústavním systému. První přímá volba v roce 2013 a vývoj ji následující dokládají pokusy oslabit moderační aspekt úřadu prezidenta republiky ve prospěch politického vůdcovství. Na to reaguje vláda předložením návrhu novelizace Ústavy, jenž se vesměs týká pravomocí prezidenta republiky. V komentáři k návrhu jsou ústavní změny roztříděny podle významu a blíže zkoumány (mírné posílení prezidenta, upřesnění pravomocí, oslabení až zrušení pravomoci). Upozorňuje se ovšem, že jakékoli změny ústavního textu mají význam pouze při existenci ochoty se ústavním pravidlům dobrovolně podřídit, anebo při tlaku institucionálního okolí na podřízení se nucené.
