The Future of the State and its Legal Authority Morning Alpenglow of Global Constitutionalism: the “joyful” Legal Science in the Post-national Society

This article is a polemic against Pavel Holländer‘s article The Modern State’s Twilight. The author focuses on the semantics of the constitutional democratic state and its operational capacity and limits in the global systems of positive law and politics. Power formerly associated with state sovereignty permeates different organizations of the globally functioning legal and political systems. Methodologically drawing on the sociological recognition of particularities and asymmetries of global society, it is possible to realize that its political and legal systems, rather than monism and hierarchical structures, are typical of pluralism and heterarchies. In the final part, the author therefore especially analyzes the concept of global legal and constitutional pluralism and tensions between the conventional jurisprudential concept of pluralism and the notion of societal constitutionalism of global society evolving independently of the state and political structures. Unlike Teubner in his theory of post-sovereign societal constitutionalism, the author concludes that the modern state is not in ‘twilight’ in the current global social condition. It actually can successfully exercise and enforce its power within the structures of global law and politics.
Czech original: Tento článek je polemikou se statí P. Holländera "Soumrak moderního státu" uveřejněnou v předchozím čísle časopisu. Autor se zaměřuje na sémantiku ústavně demokratického státu a jeho operační schopnosti i limity v rámci globálních systémů pozitivního práva a politiky. V závěrečné části autor analyzuje především pojem globálního právního a ústavního pluralismu, a to v teoretickém napětí mezi konvenčním právním pluralismem a tzv. společenským konstitucionalismem globální společnosti, který se odvíjí nezávisle nejen na státu, ale i politickým strukturách. Na rozdíl od Teubnerovy teorie postsuverénního společenského konstitucionalismu autor argumentuje, že v globální společnosti nedochází k odumírání nebo soumraku moderního státu, ale naopak se moc státu může účinně projevit a prosadit v rámci struktur globálního práva a politiky.
