Idea, Identity and Invasion: Personality Rights and the Right to Privacy as a Counterbalance and Complement to Copyright Protection in the Age of Artificial Intelligence

Generative artificial intelligence profoundly challenges the traditional concepts of copyright law, particularly the notions of authorship, originality and the creative input of a natural person. The paper examines the limits of copyright protection in relation to model training, the existence of the model itself, and the generation of outputs. It further explores the potential of personality rights and the right to privacy as alternative or complementary instruments of protection against infringements of identity, likeness, voice, or expressions of a personal nature. Using Slovak and Czech legal frameworks as case studies, the author demonstrates that these instruments may provide more effective and flexible protection than traditional copyright law. The paper concludes that a combined application of copyright, personality rights and privacy law is necessary to ensure adequate protection in the digital age.
Czech original: Generatívna umelá inteligencia zásadne spochybňuje tradičné koncepty autorského práva, najmä otázku autorstva, originality a tvorivého vkladu fyzickej osoby. Článok analyzuje hranice autorskoprávnej ochrany v kontexte trénovania modelov, existencie samotného modelu a generovania výstupov. Zároveň skúma možnosti aplikácie osobnostných práv a práva na súkromie ako alternatívnych alebo doplnkových nástrojov ochrany voči zásahom do identity, podobizne, hlasu či prejavov osobnej povahy jednotlivcov. Na príklade slovenskej a českej právnej úpravy autor ukazuje, že tieto právne inštitúty môžu čiastočne poskytnúť efektívnejšiu a flexibilnejšiu ochranu než tradičné autorské právo. Záverom sa navrhuje kombinovaná aplikácia autorského práva, ochrany osobnosti a práva na súkromie ako nevyhnutná pre zabezpečenie primeranej ochrany v digitálnom veku.
