Influence of Reference Frame of Review on Decision Making of Courts and Administrative Bodies

Decision making of Czech courts and administrative authorities is usually subjected to more than one instance of review. In this process, we can identify a relation between the “lower” and “higher” instance. Each of them uses certain criteria, a certain frame of reference, for its decision making. It can be expected from a rational law of review that lower instances can (and must) adjudge so that their decisions are not vacated. And vice versa, if a decision has been quashed, it means that the body delivering the decision erred and should have made a different decision. The article points at several cases where this requirement is not fulfilled exactly because the lower and higher instances are guided by diverging criteria. It also shows that praxis reacts to such cases, which the lawgiver does not want to solve, with an effort to converge the colli¬ding frames of reference. This is primarily manifested by the lower instance’s frame of reference being in¬fluenced by a dissimilar frame of reference of its review. Thus, the synthesis connects seemingly dissimilar situations, where analogous thought processes can be applied though. In most cases, this actually occurs; where it does not, the article can be a helpful inspiration.

Czech original: Rozhodování českých soudů a správních orgánů zpravidla podléhá několikainstančnímu přezkumu. V tomto procesu můžeme identifikovat vztah mezi „nižší“ a „vyšší“ instancí, přičemž každá z nich pro své rozhodování používá určitá měřítka, určitý referenční rámec. Od racionální úpravy přezkumu lze především očekávat, že nižší instance jsou schopny (a povinny) rozhodovat tak, aby jejich rozhodnutí nebyla rušena. A opačně, pokud rozhodnutí zrušeno bylo, znamená to, že orgán, který zrušené rozhodnutí vydal, pochybil, a měl správně vydat rozhodnutí jiné. Článek poukazuje na několik případů, kdy tento požadavek není naplněn právě proto, že nižší a vyšší instance se při rozhodování řídí jinými kritérii. Zároveň ukazuje, že na takové případy, které zákonodárce není ochoten vyřešit, reaguje praxe snahou o sbližování kolidujících referenčních rámců. To se projevuje především tak, že referenční rámec rozhodování nižší instance může být ovlivněn odlišným referenčním rámcem jeho přezkumu. Předložená syntéza tak dává do souvislostí zdánlivě zcela odlišné situace, na které však lze aplikovat obdobný myšlenkový postup. Ve většině případů se tak i skutečně děje; tam, kde nikoliv, může být článek vhodnou inspirací.
