Twenty Years of Cooperation of the Member States in Consular Protection (but not in Diplomatic Protection) of Citizens of the European Union in the World

According to the founding treaties, citizens of the European Union enjoy diplomatic and consular protection by missions of other member states in non-member states where a mission of their home state is absenting. Twenty years later, however, it is obvious that related cooperation is restricted to consular assistance. Diplomatic interventions in favour of nationals of the other member states are rare. Their diplomatic protection is missing absolutely. It is hard to cooperate in these activities due to weakness of supranational citizenship if compared with nationality and due their discretionary nature. The member states failed for years to notify and clarify this specific multilateral cooperation to non-member states. Recent effort to set detailed rules of consular cooperation with a directive encounters lack of legislation addressing many types of consular assistance to their own nationals in many member states (included Czechia). The member states also hardly find consensus on the role of the European Union. The limits of integration are reflected in retention of diplomatic relations among the member states and in continuation of consular assistance to their own nationals moving within the European Union.
Czech original: Podle zřizovacích smluv se občané Evropské unie těší diplomatické a konzulární ochraně zastupitelských úřadů jiných členských států v nečlenských státech, kde chybí zastupitelský úřad jejich domovského státu. Po dvaceti letech se nicméně ukazuje, že související spolupráce se omezuje na konzulární pomoc. Diplomatické působení ve prospěch občanů jiných členských států je vzácné. Jejich diplomatická ochrana zcela chybí. Při nich lze totiž stěží spolupracovat jak kvůli slabosti nadnárodního občanství ve srovnání se státní příslušností, tak kvůli jejich poskytování na základě uvážení. Členské státy roky zanedbávaly oznámení a ozřejmění této jedinečné mnohostranné spolupráce nečlenským státům. Nynější snaha vytvořit podrobná pravidla konzulární spolupráce prostřednictvím směrnice naráží na skutečnost, že mnohé členské státy (včetně Česka) nemají právní rámec pro mnohé druhy konzulární pomoci vlastním občanům. Členské státy také obtížně nacházejí shodu ohledně role Evropské unie. Meze integrace se ostatně odrážejí v zachování diplomatických styků mezi členskými státy samotnými a v pokračování konzulární pomoci vlastním občanům pohybujícím se v Evropské unii.
